- NC Dam Safety: Dams impounding 10 or more acres-feet of water (or dams 15 feet or higher) require a permit from NC Department of Environmental Quality Dam Safety program. For residential ponds, most fall below this threshold.
- US Army Corps of Engineers (Section 404): If construction involves filling or grading in jurisdictional wetlands or streams, a Section 404 permit may be required. - Core construction: Compacted clay core within the dam structure to prevent seepage through the embankment
- Anti-seep collars: Around any pipes that pass through the embankment (like drainpipes)
- Primary spillway: The normal overflow structure, sized to pass the expected inflow under typical wet conditions
- Emergency spillway: A secondary overflow path for major storm events that keeps water from overtopping the dam — the most common cause of dam failure
For ponds above a certain size, an engineer's review of the spillway design is appropriate regardless of regulatory requirements. The cost of engineering review is trivial compared to the cost and liability of a dam failure.
